Customs dispute in a Russian commercial court

A customs decision has been issued or an administrative appeal rejected. A court challenge under Article 198 of the Russian Commercial Procedure Code requires close attention to the deadline, evidence and precise relief sought.

Where the position usually weakens

A position weakens when the document, deadline and evidence do not fit together. Start with the facts, response period and evidence chain.

01the position was built for an administrative appeal and has not yet been developed to court standardthe procedural position should be assembled before filing
02the documents exist but are not organised into one coherent linethe evidence must withstand court scrutiny; the administrative stage alone is no longer enough
03time is being lost on an unstructured document search after the procedural clock has startedthe relief sought and amount in dispute must be stated precisely

What to check now

Start with the documents that explain the facts, deadline, money, goods and parties' actions rather than collecting the entire archive.

01

the procedural position should be assembled before filing

02

the evidence must withstand court scrutiny; the administrative stage alone is no longer enough
